El presente artículo sostiene que la norma de atribución preferente materna del cuidado personal de los hijos, contenida en el artículo 225 del Código Civil chileno, es inconstitucional, pues se funda en una discriminación arbitraria, injusta, no razonable y desproporcionada, vulneradora del principio de igualdad jurídica y material.
